An amendment to section 5 and sub-section 1 of section 8 of the Land Control Act of 1975.

The act empowers the Minister to declare by order published in the Gazette, areas of land in Botswana to be planning areas. The act also makes provisions for the orderly and progressive development of land in both urban and rural areas and to preserve and improve the amenities contained, and for the grant of permission to develop land.

The Regulations provide for the compensation of healthy cattles that come into contact with infected animals or herd. Among the regulations, it is stated that; all animals driven under supervision to a quarantine camp shall become property of the government at the moment they first enter the gate, owners will be paid the amount for which the government is able to sell such animals, in cash.

The regulations are directed towards the introduction of birds and poultry in Botswana. It is stipulated that “No poultry or birds shall be introduced into Botswana, except from South Africa, without a written permit of authorization from relevant authorities, and a certificate issued by a veterinarian authorized by the government of the country of origin.

The act makes provisions for the testing and control of the sale, export, and use of seeds in Botswana. The act establishes seed-testing stations and allows for the appointment of official public seed-testers. The act, among others, prohibits the export of agricultural/garden seeds that are government certified/tested.

The order extends the provisions of the Noxious Weeds Act to the noxious weeds listed in the schedule of the order.

The act is directed at the management of lands and areas where burweed (Xanthium spinosum) is found to be growing. Areas and lands to which the act applies shall eradicate and destroy all burweeds growing in such area or on such land.

The act provides for the registration, control, and liquidation of co-operative societies. The act oulines registration guidelines, duties and privileges of societies, rights and liabilities of members, property and funds of registered societies, audit, inspection, inquiries, liquidation, and disputes management.

The Regulations are premised on the Cooperative Societies Act of 1964. Among others, it makes provisions for: registration of societies and registration fees; address of the society to be registered; membership; nominees; division of profits; maximum liability of society with respect to loans; general meetings; committee of a registered society; compulsory by-laws; and reserve fund

The act contains the powers of the Director of Veterinary Services to declare areas as rabies control areas, and generally manage such areas. No animal shall be moved from, into, and from place to place within control areas. It also specifies the duties of owners of animals identified to be predisposed to rabies infections.

The act re-enacts, with amendments, the Livestock and Meat Industries Act, to provide for the slaughter of domestic livestock, farmed game, wild game and poultry for human consumption. The act also addresses the control and operation of abattoirs, slaughter slabs, cold storage facilities, meat processing plants, cutting premises, canning plants, and the marketing, grading and inspection of livestock and livestock products. It details the procedures for registration and operations of abattoirs.

The regulations contain directions that must be complied with by persons travelling in parts of Botswana that has been declared to be sleeping sickness areas.

The order prohibts movement of all stock in Botswana, except under permit issued for each removal by a person authorized by the Director to issue such a permit.

The order specifies the vegetable and animal products likely to convey or spread foot-and-mouth disease. The products include: hay, manure, bedding, fodder, hides, skins, milk or cream, and bones.

The act deals with the stealing of stock or produce, possession of stolen stock or produce, presumptions, trespass with intent to steal, night delivery of stock forbidden, tampering with stock or produce, search, seizure and arrest, document of identification to be furnished on disposal of stock, and acquisition of stock or produce otherwise than at public sale, among others.

The regulations make provision with respect to the prevention and fighting of animal diseases. Importation of stock shall be imported only after having obtained a permit from authorities, and certificate from a government veterinary surgeon. The regulations introduce various measures to control movement and hygiene of stock, including: import control, inoculation, examination, slaughter, stock free zones, inspection, destruction of stock, isolation of stock, impounding of stray stock, and branding of cattle.

The regulations pertain to the registration of producers’ agents in the livestock and meat industries. No person shall act in the capacity of a producer’s agent in the abattoir unless he has been registered as a producer’s agent by the licensing authority.

The regulations guide the use of boats on Botswana waters. No boat may be operated on any surface water unless it has been registered as prescribed in these regulations. The procedures for boat registration and associated timelines are provided for in the regulations.

The order specifies areas of surface waters, rivers, and lakes declared to be infested with aquatic weeds.

No person shall introduce or cause to be introduced, dispose, or exchange into Botswana, any semen, except with an issued permit from necessary authorities. The regulations apply to bovine, equine, sheep, goat or pig semen.
