It provides regulations on establishment of customer complaints units, constitution of the forum and quorum for its meetings, removal of a forum member, jurisdiction of the forum, duty of the distribution licensee to notify, procedure for filing complaints, manner of handling complaints by the forum, procedure for hearing complaints by the forum, decisions of the forum, appeal, commission to issue orders or directions, and reports to the commission.

This document provides for customer service standards of performance for Distribution Companies. Regulation 3 states that whenever a customer requests a distribution company to provide an estimate of the cost of connecting his premises to the distribution company’s low voltage distribution network and the work to be undertaken is the subject of standard pricing, the distribution company shall provide an estimate within three working days and in all other cases, the distribution company shall provide an estimate within five working days.

Its objectives are the creation, promotion and preservation of an efficient electricity industry and market and the fostering of a culture of regulatory compliance, the facilitation of the swift investigation and resolution of incidences of regulatory non-compliance and the fair and transparent determination of rights and obligations, the maintenance of a predictable, stable and effective system for the assessment of compliance in the Nigerian electricity industry and the proper allocation of responsibility, and the establishment of a system for the deterrence, penalization and application of sanction to Acts or omissions which constitute noncompliance with regulatory framework established by the Act and regulatory instruments.

These guidelines and the regulations cover procurement of new capacity by buyers who may be electricity distribution companies. Nigerian nuclear regulatory authority (NERC) sees this development as a key step in the evolution towards a fully competitive market. They do not provide guidelines or rules for the drafting of Power Purchase Agreements (PPAs). However, it is important that given the limited experience in drafting PPAs in Nigeria and indeed previous experience with poorly drafted PPAs (with a resultant adverse impact on the finances of the power sector) that there is a substantial element of standardization in the terms of the PPAs utilized. Therefore, Nigerian Nuclear Regulatory Authority will promote this standardization.

These regulations provide for the licence and annual operating fee. Chapter 2 of the document provides for the processing and licence fees for applications. It emphasizes that every application for a licence made to the Commission shall be accompanied by the non-refundable application processing fees as specified in the schedules and upon approval by the Commission of an application for a licence, the Commission shall inform the applicant, in writing, of such approval and be informed of the licence fee required to be paid by the applicant for the grant of a licence.

The objective of this methodology for estimated billing is to provide objectives for the standardization of the methods used by distribution companies (DISCOs) to estimate a customer’s power usage and accruing bills especially in instances where the DISCOs is unable to read the customer’s bill within a billing period for one reason or the other. This methodology also provides for the standardization of the indices to be considered by distribution companies in estimating the power usage of a customer connected to the electricity system without a meter. Chapter 2 emphasizes that distribution companies shall endeavor to obtain an actual reading of all meters, routine recording electricity usage at all supply addresses within their areas of operations meter reading every month, or at such other intervals as may be approved by the Commission.

The objectives of these Regulations are to provide a legal and regulatory framework for the acquisition of land and access rights for electricity projects in Nigeria; making provisions for the payment of compensation and resettlement of persons affected by the acquisition of their land for the establishment of electricity projects; and the monitoring and evaluation of project designs of licensees to ensure compliance with environmental standards.
